PERM - Alien Labor Certification
If one has an “employer willing to sponsor” him/her for the green card, s/he is interested in pursuing the PERM process.
This process is a three-stage process that entails recruitment by the employer in a newspaper or professional publication together with additional recruitment requirements. The process is designed to take six months in the first of the three stages but currently takes closer to fourteen months.
After securing the Certification the employer demonstrates his/her/its ability to pay the proffered/prevailing salary and the alien demonstrates his/her qualifications usually through a letter of experience from a former employer.
Upon securing the approval of the Immigrant Visa Petition for Alien Worker, the alien must wait for his date of priority (the date the PERM application was first submitted to the Department of Labor) to become “current. That means that the quota for people who submitted their applications on or after that date is now available.
The current processing times vary from Employment based category to category and from country to country.
